SALE TERMS & CONDITIONS AGRIMAC (UK) LTD
1. Preamble
The following conditions apply to all products offered (New or Used) services and spare parts manufactured or supplied by Agrimac (UK) Ltd
Placing an order implies that the buyer accepts these terms and conditions, and the exclusion of all others.
2. Purchase Order
Agrimac (uk) Ltd will only accept written purchase orders, excluding any other method. Orders must be signed by a person authorised to represent the applicant company. It should include the configuration of the machine or parts , price and method of payment.
3. Price of machines and Parts
Prices are expressed in pounds sterling and do not include taxes (direct or indirect). Sale conditions are EXWORKS COLCHESTER
4. Terms
The delivery times indicated on the order confirmation are approximate and may not give rise to penalties for any delays or damages. Should the order include special accessories not included in the current list price, the buyer cannot use this reason to cancel the order.
5. Modification and cancellation of purchase order
Once the purchase order is confirmed, no change in the configuration or cancellation of the order can be made without prior written authorisation by Agrimac (UK) Ltd
6. Complaints and Warranty
Any complaint about the nonconformity of the product received with regards to the products supplied, must be made according to the channels and the terms established in the general warranty procedure. The buyer expressly acknowledges having received, accepted the general conditions of our guarantee policy.
7. Returns
(1) The return of the machines will not be accepted , unless express and written authorization of the management of Agrimac (UK) Ltd. If approved, 20% of the import of the machine will be applied. Transport to the place of production will be paid by the purchaser. Also the machine must be delivered with original configuration and in perfect condition, without being used. If there are any expenses needed to be done according to Agrimac (UK) Ltd to return the machine to the original condition Agrimac (UK) Ltd is entitled to invoice this cost to the purchaser. Machine orders or special accessories not included in the current price list shall not be subject to any modification or cancellation.
(2) All parts wrongly ordered or supplied incorrectly must be returned to Agrimac (UK) Ltd within 14 days of invoice date for a refund to be issued. If parts are ordered incorrectly buy customer a 20% handling fee or £20.00 charge will apply if credit is less than £20.00
8. Payment
Except where otherwise stipulated, invoices must be paid in advance with 20% at the time of order and 80% before collection. In the case of an authorised delay payment the period shall begin on the date of invoice. Orders for special accessories or special machines are to subject to any type of payment deferment. The place for the payment obligation will be the office of Agrimac (UK) Ltd. Unless otherwise agreed.
9. Delays
Any delays in payment will automatically give rise. Without prior notice, to interest for late payment of 1% per month on delay, calculated on the amount owed and the period between the due date of the funds received in payment. The default of a debtor to a deadline after a period extension agreement, makes all debts immediately payable. This non payment will result in the automatic termination of contracts and orders.
10. Ownership
Ownership of the product will be Agrimac (UK) Ltd until the payment of 100% of the amount of the invoice issued. In the event of insolvency, bankruptcy or Liquidation of the buyer, Agrimac (UK) Ltd acquires the rights to recover the goods supplied as collateral for the pending payments to be received.
11. Protection of personal data
In compliance with the Organic Law 15/1999 of December 13 Protection of Data, personal data of The buyer will be incorporated and will be treated in the files ownership of Agrimac (UK) Ltd , These data will not be disclosed to third parties without your consent. The buyer can exercise the rights of access, cancellation ans opposition of their date by written communication to Agrimac (UK) Ltd 30 Moorside Business Park, Moorside, Colchester CO1 2ZF.
12. Applicable law and jurisdiction
The conclusion of this contract is subject exclusively to United Kingdom Law without the possibility of recourse to its rules of conflict of laws. Any dispute regarding the interpretation and / or execution of theses conditions of sale will be sent to the Courts at Colchester, Essex, unless otherwise agreed.
